1. Acceptance of Terms
By accessing or using KiesSlim ("we," "our," "us"), you ("user," "you," or "your") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use our platform.
These Terms constitute a legally binding agreement between you and KiesSlim, governing your use of our website, mobile applications, and related services (collectively, the "Service").
2. About KiesSlim
KiesSlim is South Africa's local business marketplace — connecting consumers with verified local service providers across 200+ cities and 300+ service categories. We facilitate discovery and communication between consumers and businesses but do not provide the actual services listed on our platform.

3. Platform Role and Limitations
BY USING KIESSLIM, YOU EXPLICITLY ACKNOWLEDGE AND AGREE TO ALL LIMITATIONS SET OUT IN THIS SECTION. IF YOU DO NOT ACCEPT THESE LIMITATIONS, YOU MAY NOT USE THE PLATFORM.
3.1 Intermediary Platform Only
KiesSlim operates solely as an electronic intermediary platform as contemplated under the Electronic Communications and Transactions Act 25 of 2002 ("ECT Act"). We facilitate the discovery of and communication between consumers and businesses. We do not provide, supply, endorse, or warrant any services listed on the platform. We are not a party to any transaction or agreement concluded between a consumer and a service provider through or by means of the platform.
3.2 No Verification of Business Claims
IMPORTANT — PLEASE READ CAREFULLY:
KiesSlim allows businesses to be claimed by persons who represent themselves as the rightful owners or authorised representatives of those businesses. We do not independently verify, and cannot guarantee the accuracy of, any business ownership claim submitted to the platform. We process all claims in good faith based solely on the information provided by the claimant.
By using the platform — whether as a consumer or a business user — you acknowledge and accept that:
- • A business listing may be claimed by a person who is not the lawful owner or authorised representative of that business.
- • KiesSlim bears no liability for the consequences of any incorrect, fraudulent, or unauthorised business ownership claim.
- • KiesSlim does not warrant the identity, credentials, or authority of any person who has claimed a business listing.
If you believe a business has been wrongfully claimed, you may submit a formal dispute using our Report Wrong Business Claim process, which is accessible directly from any business listing page. We will review all such reports and take reasonable steps to investigate and address valid disputes. However, the outcome of any such investigation does not constitute a legal determination of ownership, and KiesSlim expressly excludes any liability arising from the outcome of the process.
3.3 No Involvement in Disputes — South African Legal System Applies
BY USING KIESSLIM YOU EXPRESSLY AGREE THAT:
- • KiesSlim will not under any circumstances act as mediator, arbitrator, adjudicator, or conciliator in any dispute between users, between a consumer and a service provider, or between competing claimants to a business listing.
- • All disputes arising from transactions, services, reviews, or business claims must be resolved directly between the parties involved, without the involvement of KiesSlim.
- • Where a dispute cannot be resolved directly between the parties, you agree that such dispute shall be resolved exclusively through the South African legal system, including but not limited to the Magistrates' Court, the High Court, the National Consumer Commission ("NCC"), the Consumer Goods and Services Ombud ("CGSO"), or any other competent South African tribunal or regulatory body having jurisdiction over the subject matter of the dispute.
- • You irrevocably waive any right to call upon KiesSlim to intervene in, mediate, or resolve any dispute of any nature whatsoever between yourself and any other platform user or third party.
- • You indemnify and hold KiesSlim harmless from any claim, loss, damage, or liability — whether direct, indirect, consequential, or otherwise — arising from any dispute between you and another user or third party.
3.4 User Responsibility
As a platform user you are solely responsible for:
- • Verifying the credentials, qualifications, and suitability of any service provider before engaging their services.
- • Negotiating, agreeing, and concluding the terms of any service agreement directly with the service provider.
- • Resolving any payment disputes, non-performance, or service delivery complaints directly with the service provider.
- • Pursuing your own independent legal remedies through the South African legal system where disputes cannot be resolved amicably.
- • Understanding that reviews published on the platform represent the individual opinions and experiences of their authors and do not constitute endorsements or warranties by KiesSlim.
3.5 Statutory Compliance
These limitations are consistent with and governed by South African law, including the ECT Act 25 of 2002, the Consumer Protection Act 68 of 2008, and the Protection of Personal Information Act 4 of 2013 ("POPI Act"). Nothing in these Terms is intended to limit any statutory right you may hold under South African consumer protection legislation; where any provision conflicts with such statutory rights, those rights will prevail to the extent of the conflict.
⚖️ By continuing to use KiesSlim you confirm that you have read, understood, and accepted the limitations set out in this section. If you do not agree, you must stop using the platform immediately.
4. User Accounts and Registration
4.1 Account Requirements
- You must be at least 18 years old to create an account
- You must provide accurate, current, and complete information
- You must verify your phone number before submitting reviews
- You are responsible for maintaining the confidentiality of your account credentials
4.2 Account Responsibilities
- You are solely responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use of your account
- You may only create one account per person
5. Reviews and User-Generated Content
Critical Agreement: By using KiesSlim, you explicitly agree to the review policies outlined below.
5.1 Public Nature of Reviews
YOU ACKNOWLEDGE AND AGREE THAT:
- All reviews you submit will be publicly visible on our platform
- Reviews may appear in search results and be accessible to anyone
- Your name and profile information will be associated with your reviews
- Reviews contribute to public transparency about service providers
5.2 Business Contact Details
YOU AGREE THAT:
- If you claim a business listing, your contact details (phone number, email address, website, and physical address) will be publicly displayed on your business profile.
- Consumers will use these contact details to reach you directly — KiesSlim does not facilitate or intermediate any communication between consumers and businesses.
- You are responsible for ensuring that all contact details you provide are accurate, current, and that you are authorised to publish them.
5.3 Review Editing and Updates
IMPORTANT REVIEW POLICY:
- Initial reviews CANNOT be edited or deleted once submitted
- You may only add new information through follow-up updates
- Updates are appropriate when situations change (e.g., poor service gets rectified)
- This policy ensures review integrity and prevents manipulation
- All updates become part of the permanent review record
5.4 Ownership of Reviews
REVIEW OWNERSHIP TERMS:
- All reviews become the exclusive property of KiesSlim
- You grant us perpetual, irrevocable rights to your review content
- Reviews will NOT be deleted even if you close your account
- This ensures platform integrity and protects other users' access to information
- Reviews remain valuable community resources regardless of user status
5.5 Review Standards
All reviews must:
- Be based on genuine, first-hand experience
- Be factually accurate and honest
- Include appropriate proof of service when requested
- Be respectful and constructive
- Comply with our community guidelines
6. Prohibited Activities
You agree NOT to:
Content Violations
- • Submit false, misleading, or fraudulent reviews
- • Post defamatory, offensive, or illegal content
- • Share inappropriate images or personal information
- • Violate intellectual property rights
Platform Abuse
- • Create fake accounts or impersonate others
- • Manipulate reviews or ratings
- • Spam or harass other users
- • Attempt to hack or disrupt our services
Commercial Misuse
- • Use our platform for unauthorized commercial purposes
- • Scrape or harvest data without permission
- • Compete unfairly with listed businesses
- • Solicit users for external services
Legal Violations
- • Violate any applicable laws or regulations
- • Infringe on privacy rights of others
- • Share confidential information without consent
- • Engage in discriminatory practices
7. Intellectual Property Rights
7.1 KiesSlim's Rights
KiesSlim owns all rights to our platform, including but not limited to:
- Website design, layout, and functionality
- KiesSlim branding, logos, and trademarks
- AI algorithms and recommendation systems
- Aggregated data and analytics
- All user-generated content (as outlined in Section 4.4)
7.2 Content License
By submitting content to KiesSlim, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, display, distribute, and create derivative works from your content for any purpose related to our business operations.
7. Privacy and Data Protection
Your use of KiesSlim is also governed by our Privacy Policy, which complies with South Africa's Protection of Personal Information Act (POPI Act). By using our platform, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.
Key Point: Remember that reviews and associated communications may be publicly displayed as part of our transparency commitment.
9. Disclaimers and Limitations of Liability
8.1 Service Disclaimer

- • KiesSlim is ONLY a platform - we do not provide the actual services
- • We do NOT guarantee service provider quality, reliability, or availability
- • Reviews are individual opinions only - not our endorsements
- • 🚫 WE WILL NOT GET INVOLVED IN ANY DISPUTES between users and service providers
- • ALL DISPUTE RESOLUTION IS BETWEEN USERS DIRECTLY
- • Service availability may be interrupted or terminated without notice
8.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY SOUTH AFRICAN LAW, KIESSLIM SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, business opportunities, or goodwill
- Damages arising from user-generated content or third-party actions
- Service interruptions, technical failures, or data breaches beyond our control
- Any amount exceeding the fees paid by you to KiesSlim in the preceding 12 months
9. Indemnification
You agree to indemnify, defend, and hold harmless KiesSlim, its officers, directors, employees, and agents from any claims, damages, costs, or expenses (including reasonable attorney fees) arising from:
- Your use of our platform or violation of these Terms
- Your reviews or other content submitted to our platform
- Your interactions with other users or service providers
- Any violation of third-party rights, including privacy and intellectual property
10. Content Moderation and Enforcement
10.1 Our Rights
KiesSlim reserves the right to:
- Monitor, review, and moderate user-generated content
- Remove content that violates these Terms or applicable law
- Suspend or terminate accounts for violations
- Cooperate with law enforcement when required
- Modify or discontinue services at any time
10.2 Reporting Violations
Users can report content or behavior that violates these Terms. We will investigate reports and take appropriate action, which may include content removal, account warnings, or permanent bans.
11. Account Termination
11.1 Termination by You
You may close your account at any time by contacting us. However, remember that your reviews and associated content will remain on our platform as outlined in Section 4.4.
11.2 Termination by Us
We may suspend or terminate your account immediately if:
- You violate these Terms or our community guidelines
- You engage in fraudulent or illegal activities
- Your account remains inactive for an extended period
- Required by law or regulatory authorities
11.3 Effect of Termination
Upon termination, your right to access our platform ceases immediately, but our rights under these Terms (including content ownership) survive termination.
12. South African Legal Compliance
These Terms are governed by South African law and comply with:
- Protection of Personal Information Act (POPI Act): Data protection and privacy
- Consumer Protection Act: Fair business practices and consumer rights
- Electronic Communications and Transactions Act: Electronic transactions and communications
- Cybercrimes Act: Online safety and security
12.1 Consumer Rights
Nothing in these Terms limits any rights you may have under South African consumer protection legislation. If any provision conflicts with your statutory rights, those rights will prevail.
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. The parties submit to the exclusive jurisdiction of the South African courts.
13.2 Jurisdiction
Any legal proceedings arising from or in connection with these Terms or your use of KiesSlim shall be instituted in a competent South African court, including the Magistrates' Court or the High Court of South Africa, depending on the monetary value and nature of the claim. You consent and submit to the jurisdiction of such courts for these purposes.
13.3 Disputes Between Users — KiesSlim Not a Party
THIS CLAUSE IS OF CRITICAL IMPORTANCE. PLEASE READ IT CAREFULLY.
KiesSlim is not a party to any dispute between users, between a consumer and a service provider, or between any persons in connection with a business listing. You explicitly agree that:
- • KiesSlim will not become involved in, mediate, or resolve any such dispute under any circumstances.
- • Any dispute arising from a transaction, service, review, business claim, or any other matter involving another user or third party must be resolved by the parties themselves.
- • Where the parties cannot resolve the dispute amicably, the dispute must be referred to the South African legal system, including, as appropriate: the National Consumer Commission (NCC), the Consumer Goods and Services Ombud (CGSO), the relevant Magistrates' Court, or the High Court of South Africa.
- • You waive any claim against KiesSlim arising out of or in connection with any such dispute.
13.4 Disputes with KiesSlim
If you have a dispute directly with KiesSlim regarding these Terms or the operation of the platform, we encourage you to first contact us using our contact form so that we may attempt to resolve the matter informally. If the dispute cannot be resolved informally within 30 days of written notice, either party may pursue the matter through the South African courts as set out in clause 13.2 above.
14. Changes to Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will:
- Notify users of significant changes via email or platform notifications
- Update the "Last updated" date at the top of this document
- Provide at least 30 days' notice for material changes
- Consider continued use of our platform as acceptance of updated Terms
15. Severability and Entire Agreement
15.1 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
15.2 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and KiesSlim regarding your use of our platform.
